This book provides a comprehensive analysis of the impact of populism on the European democratic polity. In the last two decades, European democracies have come under strain amid growing populism. By asserting the superiority of the majority over the law, of direct democracy over representation, and claiming the necessity to defend national sovereignty against foreign interferences, the populist conception of democracy is in stark contrast with the longstanding Western notion of liberal democracy. This volume investigates populist attempts to radically change what Bobbio called the "rules of the game" of democracy from an eminently legal perspective. Weaving together normative and empirical analysis, the contributions focus on the institutions that have suffered the most from the rise of populism as well as those that have better resisted the populist tide. Special attention will be paid to the Venice Commission’s opinions and documents, as they represent the best European standards to evaluate the extent to which populism deviates from constitutional democracy requirements. The book also considers the responses of European States to the explosion of the COVID-19 pandemic. The COVID-19 pandemic has indeed been an accelerator of known and studied trends in most constitutional systems, such as the concentration of powers in the executive hands and the consequential loss of parliament’s centrality. Various forms of populism across Europe have thus found an ideal breeding ground to implement their agenda of granting the executive broad regulatory and decision-making powers while loosening parliamentary and judicial checks. Against this backdrop, the book analyses how European democracies should adapt to the challenges posed by the pandemic, as this reflection can help respond to populist threats and propose a way forward for liberal democracy.

This open access book focuses on the nexus between "party system stability" and "democratic consolidation", using Slovenia as a case study. Its findings are presented from a comparative perspective to illustrate the commonalities and differences found in research on Central European post-socialist countries and former Yugoslav countries. On the one hand, Slovenia’s characteristics (including the characteristics of its transition to democracy) are far more similar to those of Central European post-socialist countries than Western Balkan countries. On the other, Slovenia shares some similarities with other parts of the former Yugoslavia – especially its experiences with the political system of socialist self-management, elements of a market economy under socialism, and war following the end of socialism (albeit the conflict in Slovenia was very short and rather mild in comparison to those in other parts of socialist Yugoslavia). Slovenia’s experiences with rapid but limited democraticbacksliding under the Janša government (March 2019-June 2022) were halted by the 2022 national election – in contrast to the more widely known cases of Hungary and Poland, where such backsliding took place incrementally over a longer period of time that included several election cycles.

This study has two central research questions: Do democracy profiles affect policy performance? And what causes democracy profiles? Oliver Schlenkrich conceptualizes and measures different democracy profiles (e.g., libertarian-majoritarian or egalitarian-majoritarian democracies) based on trade-offs between the central democracy dimensions of political freedom, political equality, and political and legal control. In addition, the study conceptually and empirically develops a typology of political performance. Regarding the first research question, the empirical analyses of about 80 democracies from 1974 to 2017 indicate that there is not an overall better performing democracy profile. Thereby, the democracy profiles do not have an immediate effect, instead their effects require a longer period of time to manifest. With respect to the second research question, the empirical findings show that several structural and cultural factors are relevant (e.g., British heritage or a competitive culture). This work is mainly based on Bayesian statistics to cope with the complexity of the data and models.
