Legal Capacity & Gender Realising the Human Right to Legal Personhood and Agency of Women, Disabled Women, and Gender M

Free Download Anna Arstein-Kerslake, "Legal Capacity & Gender: Realising the Human Right to Legal Personhood and Agency of Women, Disabled Women, and Gender M"
English | ISBN: 3030634922 | 2021 | 168 pages | PDF | 2 MB
This book explores the role of gender in the recognition of an individual’s legal capacity. It discusses the meaning of the right to legal capacity and its two core elements – legal personhood and legal agency. It then analyses historical and modern denials of personhood and agency experienced by women, disabled women, and gender minorities – for example, prohibitions from voting, limitations on contracting, loss of personhood upon marriage, and gender binary requirements leading to an inability to exercise legal capacity, among others. Using critical feminist, disability, and queer theory, this book also offers insights into the construction of legal personhood and its role as a predictor of power and privilege. The book identifies patterns of oppression through legal capacity denial in various jurisdictions and discusses situations in which modern law continues to enforce these denials. In addition, the book presents solutions: it identifies practices to learn from in various jurisdictions around the world – including both civil law and common law jurisdictions. It also uses case studies to illustrate the ways in which existing laws, policies and practices could be reformed. As such, the book offers both a novel contribution to the field of legal capacity law and a tool for creating change and helping to realise the right to legal capacity for all.

Humanitarian Imperialism Using Human Rights to Sell War

Free Download Humanitarian Imperialism: Using Human Rights to Sell War By Jean Bricmont
2007 | 176 Pages | ISBN: 1583671471 | EPUB | 3 MB
Since the end of the Cold War, the idea of human rights has been made into a justification for intervention by the world’s leading economic and military powers-above all, the United States-in countries that are vulnerable to their attacks. The criteria for such intervention have become more arbitrary and self-serving, and their form more destructive, from Yugoslavia to Afghanistan to Iraq. Until the U.S. invasion of Iraq, the large parts of the left was often complicit in this ideology of intervention-discovering new "Hitlers" as the need arose, and denouncing antiwar arguments as appeasement on the model of Munich in 1938.Jean Bricmont’s Humanitarian Imperialism is both a historical account of this development and a powerful political and moral critique. It seeks to restore the critique of imperialism to its rightful place in the defense of human rights. It describes the leading role of the United States in initiating military and other interventions, but also on the obvious support given to it by European powers and NATO. It outlines an alternative approach to the question of human rights, based on the genuine recognition of the equal rights of people in poor and wealthy countries.Timely, topical, and rigorously argued, Jean Bricmont’s book establishes a firm basis for resistance to global war with no end in sight.

Human-Plant Entanglement and Vegetal Agency in the Poetry of Thomas Hardy and Sylvia Plath

English | ISBN: 1666955213 | 2024 | 146 pages | EPUB, PDF | 2 MB + 1517 KB
Dilek Bulut Sarıkaya scrutinizes human-plant entanglement in the poetry of Thomas Hardy and Sylvia Plath from the perspective of critical plant studies, which is committed to restoring the lost connection between humans and plants. The author offers a theoretical reading of Hardy and Plath’s poetry, focusing specifically on how plants are depicted by these two poets as self-conscious and emotional individuals who are turned into vulnerable victims of humans’ exploitative practices. The author develops a critical argument on the necessity of eradicating humans’ anthropocentric mindsets, categorizing plants as sessile, inert objects and replaces it with a plant-centric world view, perceiving plants as instantly active biological organisms who exist with their botanical accuracy rather than with the impositions of humans’ metaphoric meanings upon them.
